Penn State Never Fired Joe Paterno – His Contract Is Still Being Honored & He Will Be Allowed To Retire

On November 9, 2011 Penn State fired legendary football coach Joe Paterno in the wake of the Jerry Sandusky scandal. Oh, I’m sorry, that’s incorrect. Penn State did not fire Joe Paterno. Seriously. Here’s what Steve Garban and John Surma of the Penn State Board of Trustees had to say about Paterno’s continued employment on Thursday. From CBS:
“Coach Paterno remains employed by the University as a tenured faculty member,” they said in a statement released Thursday. “The details of his retirement are being worked out and will be made public when they are finalized. Generally speaking, the University intends to honor the terms of his employment contract and is treating him financially as if he had retired at the end of the 2011 football season.”
That’s right. Paterno is still getting paid. Penn State is still honoring his contract. And yes, they plan on sending him off into the sunset just like they would any other employee who retired after years of service to the university.
The Penn State students wanted their school to stand by the man who helped cover up years of rape of young boys and it turns out that they did. Students will be devastated to find out that all that rioting was actually over nothing. Good for you, Penn State. You continue to handle this situation with the grace of a drunken elephant.

Not sure why people find this surprising. Haven’t people learned from the Jim O’Brien fiasco that you can’t fire coaches on a whim?

Generally, a tenured faculty member has many, many more legal protections than a coach. I’m starting to believe that they “fired” him from the coaching position because he had outright refused to step aside, but they were loathe to completely break the connection. Technically there are “moral turpitude” clauses even in tenured faculty contracts, that allow them to be broken for cause. So they could have terminated him on the faculty contract too, but chose not to do so. It’s dicey, though, because if he reported the conduct and was told by superiors that it wasn’t his problem, for whatever reason, that’s a fairly strong defense in court.
There’s still something about this whole story that doesn’t make much sense. It’s easy to sit back and talk about a culture of hero worship, and how universities prostrate themselves to big-time athletics, but I think there’s more here.

I’m sorry but I can’t muster any anger about this. He coached most of the season and most of his adult life for the university. He’s nit responsible for operations of the football team anymore, isn’t that what is most important?

I called it the night of the press conference. They announced that Joe Paterno was no longer the football coach, effective immediately. They did not announce that Joe Paterno’s employment was terminated. Huge difference.
