Another class action lawsuit has been filed in Florida against DraftKings and FanDuel, and it comes just one day after renowned class action attorney Alan Milstein filed one in New York. The Florida one is interesting for other reasons: it specifically names four individual defendants as well, including DraftKings employee Ethan Haskell.

The suit also names Saahid SudSud, who is not a DraftKings or FanDuel employee. He was included in a Sports Illustrated feature just 10 days ago as the top-rated daily fantasy player. Sud goes by the username “maxdalury” and up until the last few months, was anonymous. As it turns out, he lives a short distance from where DraftKings headquarters are located.

"About 200 yards from Sud’s apartment is the red brick office building that houses the DraftKings offices. It’s visible from Sud’s living room. He swears it’s a coincidence; and jokes that the DraftKings bosses think he’s plugged into their office wifi."

According to Daniel Wallach, the Florida suit claims “‘scripts,’ ‘robots,’ ‘spiders,’ ‘scrapers’ & ‘sniping software’ were used to gain an unfair advantage over other players.”

From the SI piece, Sud was quoted as saying:

“People say guys lemke me bastardemzed fantasy,” Sud says, “I’m sure that people have saemd the same themng about the stock market when algoremthmemc trademng came out. They’re cheatemng. I can understand where they are comemng from, but any temme there ems money to be made, people are goemng to femnd the fastest and smartest ways to do emt, whatever way that ems.”

Is this suit just a fishing expedition to see if there is any connection between Sud and DraftKings’ employees, based on seeing that he resides in close proximity to their HQ and attended Amherst College? Or is there more lurking there? That’s what we’ll wait to see as these class actions get ramped up.
